information about the victim or possible suspects. oakland city officials apologizing this morning for a weekend dance party at the coliseum that prompted a long list of 911 calls. the beyond wonderland event was held in the parking lot of the coliseum saturday night and this is youtube video from that party. oakland police officers say the music from the event was so loud people from san leandro to alameda were busy calling 911 to complain about it. officials released a statement after the event apologizing to all the residents. it says in part while adjustments to the sound were made following the afternoon's sound check, they were clearly not sufficient to control the impact upon residents of our closest cities. we are committed to undertaking an immediate review of the situation to help us create new procedures for the management of audio production. 5:01. safety first. new policy changes go into effect today at a san mateo elementary school where a girl was sexually assaulted, then

dragged off campus more than a week ago. bob redell joins us live outside parkside elementary school. bob, will parents notice these changes as soon as they drop off their kids this morning? >> reporter: absolutely. some of those changes went into effect last week. the idea they would all bow implemented by today. one of the most obvious is you can see they have got a new gate that's been installed here, so this dpat agate and all the oths will be locked. you might notice that the fence is pretty short, it's still hopable, but that's an issue the school is still looking at, whether they want to raise the fence. some of the other new security measures going into effect today here, locked gates. there's only one entrance for people coming to campus. that's the main entrance. they're using that as a choke point so they can keep track of who's coming an going. no one is allowed on campus to pick up or drop their children. they must be dropped off at the front entrance.

and all visitors must sign in and wear a badge. these new measures are in response to what happened ten days ago. on friday the 21st, police say bradley morozak followed a 9-year-old student into the bathroom, groped her and took her to a location off campus. he covered her mouth so she wouldn't be able to get someone's attention. this is around 2:45 in the afternoon. once off campus, she did kick the man, threw rocks at him and escaped. she made it back to the school where people here called 911 and he was eventually arrested. the 25-year-old man from san francisco is supposed to be in court tomorrow where he could enter a plea to numerous charges filed against him, including kidnapping and child molestation. earlier that friday police say he was allegedly kicked off another elementary school campus nearby and that at a third campus nearby he allegedly offered alcohol to two students and said something inappropriate to another. reporting live, bob redell,

"today in the bay." closing arguments expected today in the trial of a former san francisco crime lab tech accused of stealing drugs. debra madden is accused of skimming cocaine from the city's crime lab back in 2009. the allegations led to the closure of the lab and prompted prosecutors to dismiss hundreds of criminal cases. if madden is convicted, she could face up to four years in prison. well, the former bay area psychiatrist accused of molesting seven of his young patients will be back in court today for a competency hearing. last year prosecutors say william ayers likely had dementia and could not be tried. state hospital doctors claim he is just faking that illness to avoid prison. police say the 80-year-old molested seven children between the ages of 8 an 13 during the early '90s. a hayward cab driver is in big trouble for alleged credit card fraud. police arrested the driver last friday at sfo after he allegedly

made purchases with altered cards. investigators say they used surveillance cameras to i.d. that suspect. they also say he was carrying drugs at the time of his arrest. the taxi driver now faces numerous burglary and drug charges, including committing a felony while on bail. an east bay community is honoring the life of a fallen chp officer. later on tonight in livermore a fund-raiser will be held for kenyon youngstrom. he was shot and killed during a traffic stop on august 4 -- september 4th. talking about the forecast everyone is talking about, the heat. we're finally in october and it is really warm. >> one of the very hot cities today will be right here in oakland, 90 degrees. very unusual for you to touch on the low 90s. of course the raiders are in town. yeah, we've got a game out

there. her going to have to take it easy and stay hydrated, as will you if you're outdoors today. it's 5:06 in palm springs and they're already 83 degrees. down south you're talking about temperatures in the 110, 120-degree range. we're going to max out around 105 degrees in the hottest cities in the bay area, so the heat is on but this is the last day of extreme heat. tomorrow we're about ten degrees cooler. in san francisco and san mateo, look at all these upper 50s up and down the peninsula. 61 in livermore, 72 degrees to wake up with in pleasanton. danville, you're at 73 this morning. of course this will be the hottest region, the tri-valley. make sure you're staying hydrated out there. by 1:00 p.m. already in the upper 80s, low 90s. san francisco will be at 78. i forecasted your high in the city right at 80 degrees, so get ready for a very hot day ahead. potentially the hottest day of the year if all pans out, we'll

just have to wait and see. temperatures today are going to require that ac in your car. mike, what else do we need this morning? >> it sounds like a cool beverage, i think. we're going to look out to the roadways where we just have some cool slowing that cleared eastbound on the 92. so a smooth drive across the water. on the east bay let's take a look. we do have an issue, a stall. southbound 680, reports are that it blocks one of your on-ramp lanes so that will affect you getting on to the freeway. the on-ramp is still open, though. smooth drive through alamo, lafayette, over towards the caldecott tunnel which is open, both bores for the westbound direction. north 880 slowing approaching the construction zone likely moving those cruiews right now. and in the south bay an easy drive, northbound with headlights at 101 and 680, a smooth flow of traffic, not a problem. well, you're here this morning, mike, so i take it you didn't win, but someone in the

it is 5:11. welcome back, everybody. visa closing its very last office in san francisco today. the credit card company says it's moving itself and close to 100 employees across the bay to its foster city headquarters. visa said instant wanted to have all of its bay area employees under one single roof. the company has been consolidating its workforce since 2007. we all know that mobile devices are all the rage but not everyone is jumping on board. a pew research study finds only half of all adults in the country own a smartphone or tablet. it doesn't seem right. only one-third they say use their devices to view news

stories and video clips at least once a week. a third of adults surveyed also subscribe to traditional printed newspapers and about 20% of mobile news users paid for an online news subscription. >> about 1% still have those big brick phones too, right? major recall this morning affecting 40,000 cars out on the road. for that and all the news where the bell we turn it other to seema mody, live at cnbc world headquarters. >> reporter: hi there. futures are higher at the moment as wall street begins the first day of the fourth quarter. the dow rose 4% and the nasdaq 6%. there is a fair amount of economic data out this week. today we get numbers on manufacturing and construction spending and fed chairman benber napg speaks this afternoon. the dow falling 48 points friday, the nasdaq moving about 20 points. here's the big news that you were mentioning. general motors is recalling more

>> that's what i want. or i'll take the yankees as well. we want attention on our giants when they make it to the world series. good morning to you. any sort of outdoor activities today, you want to do it early. we've got a lot of sunshine out there this morning right off the bat. the sun is going to rise just after 7:00 a.m. blazing heat as a result. what i do want to point out is as we get that sunrise between 6:45 and 7:15 with all that haze in our atmosphere, it's going to be phenomenal. we'll get reds and oranges and show those to you throughout the morning. 62 to start in san jose. we're going to show you some of your south bay cities. 75 in campbell, you're at 78 in cupertino at this point so that's an indication of a very hot day ahead. those microclimates are kicking in as we wake up with very warm conditions. we'll see high pressure just about as strong as yesterday.

south just enough, we could be talking about potential for a quarter of an inch to half of an inch of rain up there so it's going to get very interesting around here as we've got a roller coaster ride to get through this week. 5:17. find out how your ride to work is going. >> all right, so that's a look ahead. this is 880 north past the coliseum. i was watching for any slowing as we did have some construction crews, looked like they were clearing. right here we have the event, raiders and the a's both, good luck on their games. just a minor delay approaching the downtown area for northbound 880. westbound 580 moves smoothly through oakland. easy drive through livermore and pleasanton and just the volume causing an issue. coming out of the altamont pass, slow coming off the merge with 205. construction getting on to north

or south 880 but auto mall parkway is an alternate to connect smoothly from 680 over to 880. south bay commuters are moving nice rein the northbound direction, 101, 880 all the way along the peninsula. look at palo alto, a smooth flow and very clear drive for 101. back to you. environmentalists say they believe a plan to study earthquake risk near a nuclear power plant on the central coast could ultimately put marine life at risk. pg&e wants to use giant air cannons to emit sound waves in the ocean near the diablo canyon power plant. they will create 3-d maps of fault zones discovered pack in 2008 but a state study found the testing was likely to harm local marine life and the environment there. the effort to conduct the testing has become more urgent since the disastrous quake off the coast of japan that knocked the fukushima power plant offline.

same-sex couples are now to be considered family members thanks to a new order from the obama administration. the order gives some temporary relief to couples facing deportation like brian willingham and alfonso garcia from orinda. garcia has been embroiled in deportation proceedings after a traffic stop last year. house minority leader nancy pelosi praised the move by the obama administration but is urging congress to do away with the defense of marriage act which bars the government with giving federal benefits to married same-sex couples. young undocumented immigrants will soon be eligible to get a driver' license in california. a new law signed by governor jerry brown allows immigrants to apply f a license if they qualify for the new federal work permit program. they must be 30 years or younger and must have come to the united states before they were 16. the new law takes effect january

1st. another new law will now require parents who choose not to have their children immunized sign a form indicating they understand the risks and benefits of vaccines. the goal is to ensure parents are educated on the purpose of vaccines so they can make fully informed decisions on whether to opt out. that new law takes effect in january of 2014. the time is 5:20. coming up, you might want to grab those reusable bags. the plastic bag ban is expanding in another city today. plus former governor arnold schwarzenegger releases his tell-all autobiography today. what it says about the breakup of his marriage. here you go little man.

hp pavilion where unless something changes quickly we won't see any sharks in action any time soon, we're talking about on the ice. it is monday, october 1st. this is "today in the bay." 5:30 straight up, good morning, everybody. i'm jon kelley. >> and i'm laura garcia-cannon. happening now, the coast guard continuing its search around the clock for two missing boaters whose boat capsized near pigeon point. two of the men were wearing life jackets and swam to shore, but the other two are still missing this morning. they were not wearing life jackets. the coast guard searched the water by both helicopter and boat overnight. the man accused of killing seven people at an oakland university is set to appear in court today. he is facing murder and attempted murder charges.

he is expected to be in court for a pretrial hearing. goh was a nursing student when he allegedly opened fire on is classmates at a teacher, killing a total of seven people. opening statements are set to begin in the murder trial of gisele esteban. she is abused of killing michelle le and dumping her body between pleasanton and sunol in may of last year. le's body was found nearly four months later. prosecutors say esteban blamed le for wrecking her relationship with a former boyfriend. that trial is expected to last a month. 5:31. the south bay mother accused of using her daughter as a shoplifting accomplice and abducting her young son could be in court today. 38-year-old marcy keelin was arrested in nevada friday night. she could have an extradition hearing today. on friday, keelin allegedly abducted her 11-month-old son. police say he is okay. now, prior to that, she was wanted for shoplifting from a

morgan hill safeway store. keelin and her 10-year-old daughter allegedly stole more than $150 in groceries. police say keelin drove off when safeway employees confronted her and her daughter outside the store. parents at an elementary school in san mateo will notice some changes this morning when they drop their kids off. that school is tightening their campus safety policy after a 9-year-old girl was groped and dragged from the girls bathroom of the school less than two weeks ago. bob redell is live outside parkside elementary school where the new safety measures will be taking place this morning. bob, good morning. >> reporter: good morning to you, jon. yeah, these are measures that some went into effect last week, all should be implemented by this morning when school starts here this monday morning. basically these new measures are designed to keep people off campus and make it harder to get on campus. they just added this new gate here. all the gates, including this one as you can see right there are now locked. they are going to discuss

there. whenever we get this hot, we do have indications for your health you need to be advised of. 90s to 100 today. watch for dehydration. we'll post all the warning signs for heat exhaustion on our facebook page. poor air quality inland will add to your respiratory problems if you already deal with those. elderly children and pets are the most susceptible you want to keep indoors between 1:00 and 6:00 p.m. that's when the heat is at its worst. we're talking about 103 degrees in some of your bay area cities today, like livermore, like fairfield, 102 in gilroy, 90 in oakland and 80 in san francisco. the good news is tomorrow we shave off 5 to 10 degrees and we continue to trend cooler as we head throughout the week so we'll take you through that seven-day forecast. 5:36. first we want to check on your drive. mike, do you have ac in your car? >> i do. despite the fact that it is spare the air day and we're encouraging folks to use car pooling, we've seen a lot of

international forces. officials say the rest of the dead are civilians and police officers. the taliban has claimed responsibility. the supreme court is starting its brand new term today and there are a number of major cases that they will be sk asked to decide on. tracie potts is live on capitol hill with a look at some of those key cases out there. good morning. >> reporter: one of them of much interest to californians, jon, good morning, everyone. prop 8, which was approved by the voters, turned down boy the lower courts, now makes its way to the u.s. supreme court. it is on the agenda for this term along with other cases from other states that have to speak to the issue of same-sex marriage, the defense of marriage act, whether or not benefits can be denied to same-sex couples. it is one of the big sets of cases that the court is expected to look at. among them, the voting rights act. several states looking at whether or not they can change their voter i.d. laws, and that

could have huge impacts. affirmative action, a case coming up pretty quickly next week. the university of texas. they're deciding whether or not race can be used in admissions, and there will bow a lot of attention on chief justice john roberts. the last day he crossed over and voted against the conservative majority upholding most of president obama's new health law. as a result, a lot of conservatives very nervous as they go into this new term wondering whether or not chief justice roberts may be an unpredictable vote. jon. >> a lot to look forward to. tracie potts, thank you very much. a little more than a month away now from decision 2012, and this week the presidential debates begin. president obama and mitt romney both preparing for their first debate in denver wednesday night. republicans are calling for more pressure on the president's foreign policy. in today's "wall street journal" romney calls mr. obama's policies dangerous. both sides are downplaying

hanging up front in the team store here in oakland that says oakland a's feeling lucky and that's certainly how the fans are feeling this morning and the team, well, they're playing exceptionally well. you really can't fault them. and what's happening tonight is huge. they could clinch a playoff berth tonight. all eyes on the coliseum over the next three days. fans went absolutely wild with the 5-2 win over seattle before a crowd of 21,000 people here at the coliseum. they can clinch a wild card spot in beating texas once or by having tampa bay and the los angeles angels lose once. that would be, as you said, the first playoff trip since 2006 and some long overdue celebrations at the coliseum clubhouse. >> for a while now, we go out and battle every day and no matter if we're winning or losing at the time, we're going to balgt till the last out. we feel like we can win every gach game.

quickly. i want to start with something we don't usually get, especially this time of year, a crystal clear picture of san francisco where you can see for ten miles this morning. we have perfect visibility just about everywhere as long as you discount that thick layer of haze throughout the valleys. i want to start out with the current temperatures. 83 degrees at 5:46 in palm springs. yeah, it's going to be really hot in southern california. for us we're talking about 103 degrees max in some of the warmest cities across the bay but that is warmer than we typically get across the bay area. drink lots of water, throw it in the freezer now. 57 degrees in sunnyvale, we are at 58 degrees right now in san francisco. even san francisco touching on the low 80s today, so even warmner danville, 69 to start, close to 70 degrees. we stop the clock right at 7:00, 8:tonight. that's when that marine layer will start to approach the coastline but it's not going to

reach us until we hit wednesday. that's when we're expecting significant cooling. temperatures dropping back into the 80s. we've got a few hot days to get through first, today being the hottest of the whole week and the whole heat wave so far. i want to make sure you're ready. it's going to be even hotter than yesterday. so we have elevated fire danger, plenty of triple digits expected all across the tri-valley and getting close to 90 degrees even in oakland today. poor air quality as a result, a spare the air day. if you don't have to drive to work, if you can stay indoors as much as possible today, we advise that you do that. air quality is unhealthy, especially if you already suffer from respiratory issues or asthma. so look at the downward trend. 96 tomorrow, 91 wednesday. the heat breaks back to the 80s thursday and friday. we've got a really juicy system of low pressure. it just depend on how southward the jetstream dips as we head into this weekend. if it dips to the south just

enough, we could be measuring up to half an inch of rain up in santa rosa by sunday. wine country, you're looking the best for the rain. it might have been the last hot weekend of summer. mike, i notice a lot of people going on 17 over to the beach. >> yeah, some people might get the sick day calling in going on here. we're looking at 101 as folks are making hair way to work as well as some folks to school underneath that 680 interchange. this is northbound 101. we'll show you the maps because that's the first burst we typically see for san jose. that's the slow from 680 up to 880. the second burst starts about 6:fitch. right now 87 around capital and then approaching the 880 interchange, those spots showing heavier volume and slowing as well as the surface streets. we'll move over to fremont where we have 880 getting on to north

or south 880, the traffic flow is disrupted by the construction there. stay clear of that and use auto mall parkway to the north and that connects you without any problem. a smooth drive approaching that interchange with 92 but slowing out of castro valley and off the castro valley y. a live look across to the foster city side of the bridge, that volume really building too. no major slowing and we'll end with the last shot of the bay bridge toll plaza. cash lanes, there you go, guys, back to you. it's 5:49. the boy scouts of america says it will inform policend sheriff departments about suspected abusers that once worked in their ranks. the abusers are named in a perversion file the scouts have kept for decades. a court has ordered the group to release those files from 1965 to 1985 this month. a spokesperson for the scouts says the order has prompted the organization to go through the file and report any offenders to the police. belmont police at this hour

still looking for witnesses who may know more about a bizarre crash and shooting along highway 101 over the weekend. it happened in belmont but officers shut down more than three and a half miles of freeway between ralston avenue and holly street in san carlos. this causing major traffic delays for hours. a red dodge charger was driving south on 101 about 3:30 yesterday when somebody drove up beside it and started shooting. that charger crashed into a fence injuring the woman and two men inside. the other car drove off and police still looking for it. >> we have the charger with multiple bullet holes in it and injured occupants. we're still actively investigating this case, so if anyone saw any -- the shooting, anything leading up to the shooting or anything after the shooting, including the crash, we'd appreciate any information we could get. >> all three victims of the charger were taken to a nearby hospital. investigator went to meet with

temperatures are looking good out there. it's cold in santa rosa and napa, a little on the cool side this morning. however, we've got 60s in san jose. santa rosa, you're in the upper 50s. once that sun comes out just after 7:00 a.m. you'll clearly see that layer of haze. however, we're expecting a beautiful sunrise. temperatures will start to get hot between the hours of 12:00 and 6:00. that is the peak of the day. 88 degrees, though, as you break for lunch in livermore. 85 in antioch. you'll be at 74 in san francisco at noon today so you can imagine temperatures smashing records as we head throughout this afternoon. 103 in livermore, 101 in concord and 80 in san francisco. happy to tell you this will be the hottest day of the heat wave and temperatures trend downward. even some showers on that seven-day. we've got a lot to talk about when it comes to your full forecast. mike, what are you tracking out there for us? >> i'm also tracking the weather, that's very interesting. we're also following the traffic here. 101 coming up the peninsula northbound with these
